If you do not agree to these Terms, you may not access or use the Platform. We reserve the right to modify these Terms at any time. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.
Important:
These Terms include an arbitration agreement and class action waiver that affect your legal rights. Please read Section 12 carefully.
2. Eligibility
To use the Platform, you must:
Be at least 18 years of age, or the age of majority in your jurisdiction
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Platform under applicable laws
Not have been previously suspended or removed from the Platform
By using the Platform, you represent and warrant that you meet all eligibility requirements.
3. User Accounts
3.1 Account Types
The Platform offers two primary account types:
Fan Accounts:
For users who wish to discover, follow, and support performers
Performer Accounts:
For content creators, artists, and entertainers
3.2 Account Security
You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
3.3 Account Information
You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate.
4. Gitit Points (GP) System
4.1 Overview
Gitit Points ("GP") are the virtual currency used within the Platform for transactions between Fans and Performers.

4.3 GP Usage
Fans may use GP to tip performers, join fan clubs, and access exclusive content
Performers earn GP through tips, fan club memberships, and platform activities
GP has no cash value until converted through official cashout procedures
Note:
GP balances are non-transferable between accounts and cannot be sold or exchanged outside the Platform.
5. Performer Terms
5.1 Performer Responsibilities
As a Performer, you agree to:
Provide accurate profile information and maintain an up-to-date presence
Own or have rights to all content you upload
Not impersonate other artists or misrepresent your identity
Comply with all applicable laws regarding content creation and distribution
Respond to fan interactions in a respectful manner
5.2 Fan Club Pricing
Performers may set their own Fan Club membership prices within Platform limits:
Minimum: 100 GP
Maximum: 10,000 GP
5.3 Media Upload Limits
Audio samples: Maximum 1 minute, ~2MB file size
Video samples: Maximum 1 minute, ~15MB file size
Profile images: Maximum 5MB
5.4 Performer Rank System
Performers are ranked based on total GP earned, ranging from "Rookie Reserve" to "ABG Elite." Ranks are cosmetic designations and do not affect Platform fees or privileges.
6. Fan Terms
6.1 Fan Responsibilities
As a Fan, you agree to:
Use the Platform to discover and support performers in good faith
Not harass, stalk, or send inappropriate messages to performers
Respect performer content and not redistribute without permission
Not create multiple accounts to manipulate rankings or abuse promotions
6.2 Following & Fan Clubs
Follow:
Free - Subscribe to performer updates with optional notifications
Fan Club:
Paid (GP) - Join performer's exclusive community with premium access
6.3 Fan Rank System
Fans earn ranks based on total GP earned through engagement, ranging from "Lurker" to "Hall of FAN-er."
7. Content Guidelines
7.1 Acceptable Content
The Platform welcomes creative content in the following categories:
Music (original compositions, covers with proper licensing)
Comedy and entertainment
Poetry and spoken word
Social media content creation
Supernatural/holistic/spiritual content
7.2 Prohibited Content
The following content is strictly prohibited:
Content that infringes intellectual property rights
Sexually explicit or pornographic material
Content promoting violence, hate speech, or discrimination
Illegal content or content promoting illegal activities
Spam, malware, or deceptive content
Content involving minors in any inappropriate context
8. Payments & Fees

8.2 Refund Policy
GP purchases are generally non-refundable. However, we may issue refunds in cases of:
Users are responsible for any taxes applicable to their transactions. Performers earning income through the Platform may be required to provide tax documentation.
9. Prohibited Conduct
Users may not:
Violate any applicable laws or regulations
Use the Platform for any fraudulent or deceptive purposes
Attempt to gain unauthorized access to Platform systems
Interfere with or disrupt Platform operations
Scrape, harvest, or collect user data without authorization
Create fake accounts or impersonate others
Manipulate rankings, reviews, or engagement metrics
Engage in money laundering or other financial crimes
Circumvent Platform fees or payment systems
Harass, threaten, or intimidate other users
10. Intellectual Property
10.1 Platform IP
The ABG Gitit Platform, including its design, features, and content created by us, is owned by Anybody Git It Entertainment and protected by intellectual property laws.
10.2 User Content
You retain ownership of content you create and upload. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Platform.
10.3 DMCA Compliance
We respect intellectual property rights and will respond to valid DMCA takedown notices. To report infringement, contact us at ABGEnt617@gmail.com.
11. Termination
11.1 Termination by User
You may close your account at any time through account settings or by contacting us. Unused GP balances may be forfeited upon account closure.
11.2 Termination by Platform
We may suspend or terminate accounts that violate these Terms, engage in prohibited conduct, or pose security risks. We will provide notice when possible.
11.3 Effect of Termination
Upon termination:
Access to the Platform will be revoked
Performers may cash out remaining GP balances (subject to review)
Fan GP balances may be forfeited if termination is due to Terms violations
Content may be retained for legal and operational purposes
12. Disclaimers & Limitations
12.1 Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABG GITIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
12.3 Dispute Resolution
Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive the right to participate in class action lawsuits.
